by these Terms and Conditions, which include our Privacy Policy. These Terms and Conditions were last

A. Collection of Personally Identifiable Information by TheLuckyChild.com
We do not collect personally identifiable information about you, except when you provide
it to us. For example: If you decide to complete a user registration form or on-line survey,
you may be asked to provide certain information or your contact information (name,
e-mail address, mailing address, telephone number, your child's birthdate for the purpose
of sending personalized birthday greetings, etc.), age group, gender, product likes/dislikes,
and what products you use from TheLuckyChild.com. If you decide to place an order, we
need to know your delivery and billing address, credit card number and expiration date.
If you would prefer us not to collect any personally identifiable information about you, then
please do not provide us with any such information. When you submit your personally
identifiable information on the Site, you are thereby giving your consent to the collection
and disclosure of your personally identifiable information as set forth in this Privacy Policy.
B. Use of Personally Identifiable Information by TheLuckyChild.com

TheLuckyChild.com to create and deliver to you our newsletters, product updates,

at the Site, e-mailing our contact e-mail addresses or placing an order, we may

regarding your customer service requests or specifications you have made on a
particular order. For example, all registered users will receive an e-mail welcoming
them to TheLuckyChild.com and to confirm their registration. You may also receive

12. Disputes
With respect to any dispute regarding the Site, all rights and obligations and all actions
contemplated by these Terms and Conditions shall be governed by the laws of the State of
Ohio, as if the Terms and Conditions were a contract wholly entered into and wholly performed
within the State of Ohio. Any dispute relating in any way to your visit to the Site shall be
submitted in confidential arbitration in Ohio, except that, to the extent you have in any manner
violated and/or threatened to violate our intellectual property rights or the intellectual
property rights of our affiliates, partners or licensors, we may seek injunctive or other
appropriate relief in any court and you consent to exclusive jurisdiction and venue in any such
court. Arbitration under this agreement shall be conducted under the rules then prevailing of
the American Arbitration Association. The arbitrator's award shall be binding and may be
entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted
by applicable law, no arbitration under this Agreement shall be joined to an arbitration
involving any other party subject to this Agreement, whether through class action
arbitration proceedings or otherwise.

replace such provision with one that is valid and enforceable and which achieves, to the extent
possible, our original objectives and intent as reflected in the original provision.
